6. Buying from our shop

6.1 The seller

The seller is Exhausted Humans, Rua Moreira Cardoso 1B, 2770-168 Amadora, Portugal. Email: hello@exhaustedhumans.com.

6.2 Products

Product images show the design as closely as possible, but colours can vary slightly between screens, and the placement of a print can vary slightly from item to item. The size of each item is given with the item.

6.3 Prices and delivery costs

Prices are shown in euro (EUR), Polish zloty (PLN), US dollars (USD) or pounds sterling (GBP), depending on where the order is delivered and include VAT where it applies. Delivery costs are shown at checkout before you place your order. An order delivered outside the European Union may attract customs duties or handling fees on delivery, and the recipient pays them.

6.4 Ordering and the contract

You place an order by choosing products, entering your details and confirming the order with an obligation to pay. We then send you an email acknowledging receipt. The contract is concluded when we confirm your order by email. We may decline an order before that confirmation, for example if a product is unavailable or its price was shown in obvious error, and in that case we refund any payment immediately.

6.5 Payment

You can pay by the methods shown at checkout. Payment is taken when you place your order.

6.6 Delivery

We deliver to the countries that can be chosen at checkout. Most orders are dispatched within 1 to 3 business days, and some might take longer. Delivery then usually takes 2 to 8 business days, depending on the destination and the carrier. In any case we deliver within 45 days of the conclusion of the contract, unless we agree otherwise with you. The risk of loss or damage passes to you when you, or a person you have named other than the carrier, receive the goods.

6.7 Your right to withdraw

This section applies to consumers whose order is delivered in the European Union or the United Kingdom. An order delivered anywhere else is final sale and cannot be returned or exchanged, unless it is faulty, damaged or not as described (section "If an item is faulty"). This does not affect any right that the law of your country gives you and that cannot be excluded.

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods. If you ordered several goods delivered separately, the period expires 14 days after you acquire physical possession of the last of them.

To exercise the right of withdrawal, you must inform us (Exhausted Humans, Rua Moreira Cardoso 1B, 2770-168 Amadora, Portugal, hello@exhaustedhumans.com) of your decision to withdraw from this contract by an unequivocal statement, for example an email. You may use the model withdrawal form at the end of these terms, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (with the exception of any supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery we offer), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise, and you will not incur any fees as a result. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earliest.

You must send back the goods to Exhausted Humans, Rua Moreira Cardoso 1B, 2770-168 Amadora, Portugal without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

6.8 If an item is faulty

We are responsible for any lack of conformity of the goods that exists when they are delivered and becomes apparent within two years of delivery, or within a longer period where the law of your country provides for one (for example, three years for consumers in Portugal). If an item is faulty, damaged or not as described, write to hello@exhaustedhumans.com with your order number, a description of the problem and, where possible, photographs. You are entitled to have the item repaired or replaced free of charge and, where that is impossible or disproportionate or is not done within a reasonable time, to a price reduction or to terminate the contract and receive a refund. We reply to every complaint within 14 days.

6.9 Complaints and disputes

If you are not satisfied, write to us first at hello@exhaustedhumans.com. You may also use out-of-court dispute resolution. The entities authorised to resolve consumer disputes in Portugal are listed by the Direção-Geral do Consumidor at consumidor.gov.pt, and you may submit a complaint through the electronic complaints book at livroreclamacoes.pt.
